The rental agreement is the most important form that a landlord uses.  It is the source of all your rights.  A well drafted rental agreement is worth its weight in gold.  Conversely, a poorly drafted or "general purpose" rental agreement (i.e., the type available at most stationery stores) can cause you more problems than you might imagine.  The cost to resolve those problems may greatly exceed the money you "saved" by drafting your own rental agreement or using a "general purpose" form.  Similarly, forms drafted by persons and/or companies not familiar with Arizona law, especially the NEW Arizona specific requirements, may be inadequate and may expose you to significant financial liability.

 

 

 

 

 

 

 

 

 

 

Custom Drafted Residential Rental Agreement  $495.00*

For landlords that own and manage their own properties, I will custom draft a residential rental agreement specifically for you and your rental unit(s).  I will meet with you personally or by telephone to gather all the requisite information.  I will then draft a rental agreement specifically for you.  In addition, I will include contract clauses that favour you, the landlord (i.e., authority to dispose of personal property if tenant abandons premises; payment of attorneys' fees and court costs, even when not contested; discretion to accept partial payments (or not) and, if accepted, how partial payments are to be applied; fee for issuing Five-Day Notice to Pay or Quit; and more).  You will have the opportunity to review the rental agreement as many times as you wish before the final version is printed.  I will give you the final version in “hardcopy” and/or in a .PDF form and/or convert it to a program that you use, so you may make minor adjustments whenever you wish.  When completed, you will be confident in the knowledge that your rental agreement was drafted to protect your interests and complies with current Arizona law.

 

 

Wherever you are in Arizona (or even out-of-state), help will only be a phone call, fax or e-mail away.  Included in the price is one hour of telephonic consultation.  And you may divide up the hour however you like – one 1-hour call, six 10-minute calls, 4 faxes, 6 e-mails – whatever!*  Additional time is available at my normal hourly rate.

Rather than draft a completely new rental agreement, some people prefer that I review and update their existing rental agreement.  In that case, I will review your existing rental agreement form to ensure that it complies with the ALL the new statutory requirements.  Any language in your rental agreement that is ambiguous or unenforceable will be brought to your attention and alternate language suggested.  Mandatory notice requirements will be provided.  Suggestions about other provisions that should be included in your rental agreement will be made.

For professionals (e.g., real estate agents/brokers, property managers, leasing agents, etc.), I will custom draft a residential rental agreement that protects you, as well as your client.  I will meet with you personally or by telephone to gather all the requisite information.  I will then draft a rental agreement specifically for your company, that you may copy and use for multiple properties and/or multiple owners/landlords.  Naturally, I will include contract clauses that favour you (e.g., indemnity, limited damages, etc.) and that favour the landlord (i.e., authority to dispose of personal property if tenant abandons premises; payment of attorneys' fees and court costs, even when not contested; discretion to accept partial payments (or not) and, if accepted, how partial payments are to be applied; fee for issuing Five-Day Notice to Pay or Quit; and more).  You will have the opportunity to review the rental agreement as many times as you wish before the final version is printed.  I will give you the final version in “hardcopy” and/or in a .PDF form and/or convert it to a program that you use, so you may make adjustments whenever you wish.  When completed, you will be confident in the knowledge that your rental agreement was drafted to protect your interests, your client’s interest and that complies with all the NEW Arizona law.
