Special Detainer actions (residential rental evictions)
Forcible Detainer actions (commercial and industrial rental evictions and post-foreclosure
eviction of tenants and/or occupants)
All legal work will be handled by Carlton C. Casler, the managing member of the Casler
Law Office, PLLC, including: drafting of Summons, Complaint, proposed form of judgment,
as well as all court appearances. Specifically, Mr. Casler will:
- Review facts with you, to determine the best way to proceed
- Prepare initial notice (if not already done)
- Draft the eviction lawsuit and file with court (filing done by court runner)
- Have tenant(s) served with Summons & Complaint (done by process server)
- Appear personally for trial
- Follow up to see if Writ of Restitution is necessary
- Counselling regarding various post-judgment requirements and procedures
- Evaluate whether your rental agreement needs to be revised or replaced
- Assist with disposing of any personal property left behind by tenant
- Assist with the Disposition of Deposit form (and provide form, if needed)
- Record judgment (including completing the Judgment Information Statement)
- Make initial demand for voluntary payment from tenant (required before garnishment
of wages)
- Counselling regarding your practices and procedures, to help avoid future problems
