Custom Drafted Residential Rental Agreement

The rental agreement is the most important form that a landlord uses. It is the source of all your rights.  A well-drafted rental agreement is worth its weight in gold. Conversely, a poorly drafted or “general purpose” rental agreement (i.e., the type available at most stationery stores) can cause you more problems than you might imagine. The cost to resolve those problems may greatly exceed the money you “saved” by drafting your own rental agreement or using a “general purpose” form. Similarly, forms drafted by persons and/or companies not familiar with Arizona law, especially the NEW Arizona specific requirements, may be inadequate and may expose you to significant financial liability.

  • Did you know that “knowingly” including a prohibited provision in a rental agreement is a violation of Arizona law and may result in a penalty of two months’ rent? (See A.R.S. Section 33-1315(B)). As a landlord, most judges presume that you know the law.

For landlords that own and manage their own properties, I will custom draft a residential rental agreement specifically for you and your rental unit(s). I will meet with you personally or by telephone to gather all the requisite information. I will then draft a rental agreement specifically for you.

In addition, I will include contract clauses that favor you, the landlord, such as:

  • Liquidated Damages clause
  • Daily late fee
  • Drive-by fee
  • Missed appointment fee
  • Notice Fees (i.e., fee for issuing Five-Day Notice to Pay or Quit and other notices)
  • Recapture of rent concessions if tenant vacates before end of lease
  • “Deductible” that tenant must pay when tenant requests repairs
  • “Guest” rent
  • “Pet” rent
  • Tenant responsible for HOA fines
  • Compensation to landlord when landlord does cleaning and/or repairs
  • Authority to dispose of personal property if tenant abandons premises
  • Payment of attorneys’ fees and court costs, even when not contested
  • Discretion to accept partial payments (or not) and, if accepted, how partial payments are to be applied
  • Limited damages against landlord if property is foreclosed
  • Crime Free language (like a “Crime Free Addendum,” but included in the body of the lease)
  • Death of Tenant clause
  • “Normal wear and tear” is defined in the lease, rather than left to tenant’s or judge’s interpretation
  • “Replacement Value” clause; obligates tenant to pay replacement cost, rather than prorated or depreciated value for property damage

Rather than draft a completely new rental agreement, some people prefer that I review and update their existing rental agreement.  In that case, I will review your existing rental agreement form to ensure that it complies with ALL the new statutory requirements.  Any language in your rental agreement that is ambiguous or unenforceable will be brought to your attention and alternate language suggested. Mandatory notice requirements will be provided. Suggestions about other provisions that should be included in your rental agreement will be made.
